(2) Must, at a minimum, hold a credential that is equivalent to being

licensed as a Registered Nurse or a Licensed Practical Nurse.

HEALTH SCREENING

It is required, prior to the first-time enrollment in kindergarten or first

grade, that every student must be screened for hearing, vision, speech

communications, health or medical problems, and for developmental

disabilities. If warranted by screening results, districts must conduct

further assessments. Parents are to be provided information on the

required screening program.

The district may: provide any of the required screenings itself; contract

with a private provider or governmental entity for the screenings; or

request that the parent obtain the screenings from a provider selected

by the parent. (Any parent requested to obtain such screenings may

sign a written statement that the parent does not wish to have the

screening performed.)

If the district requests that the parent obtain any screening, the district

provide a list of providers and information about screening services

within the community for parents who are unable to afford them.

“HIGH-PERFORMING”

TEACHERS,

CONSISTENTLY

The State Board of Education is required to adopt rules to define a

“high-performing” teacher.

In addition, these rules must exempt consistently high-performing

teachers from the requirement to complete any additional

coursework for the renewal of an educator license and from any

requirements prescribed by the district's or school's professional

development committee in regard to such coursework.

HOLIDAYS, SCHOOL

The board may dismiss school on certain days: New Year’s Day, Martin

Luther King Day, President’s Day, Memorial Day, Independence Day,

Labor Day, Columbus Day, Veteran’s Day, Thanksgiving, and

Christmas. Also included in this section of law are added any day

declared by the President or Governor to be a day of “fast, thanksgiving,

or mourning” or the days designated for staff development. It should be

noted that these days are all permissive rather than mandatory. This is

not the same as any requirement for holiday pay for staff (especially

non-licensed staff) as this is a separate issue altogether.

HOME SCHOOLED

STUDENTS IN

EXTRACURRICULAR

ACTIVITIES

Students receiving home instruction must be permitted to

participate in an extracurricular activity at the school of the student's

resident school district to which the student would otherwise be

assigned.

The superintendent of a school district is authorized, but not

required, to allow a student receiving home instruction who is not

entitled to attend school in that district to participate in a school's

extracurricular activities, if the activity is not offered by the student’s

resident district.

A school district, interscholastic conference, or organization that

regulates interscholastic conferences or events is prohibited from

imposing eligibility requirements on homeschooled students that

conflict with the provisions above.

IMMUNIZATIONS

Board of education also may adopt policy that requires pupils to be

vaccinated and immunized to prevent the spread of communicable

disease. However, such policy cannot be “inconsistent” with Ohio’s

immunization requirements found in ORC 3313.671. Districts shall
