Dear [Name]:

As you know, you were employed as a temporary/[provisional/categorical] employee in

accordance with the Education Code. The services of such employees may be terminated at the

expiration of the school year without regard to other requirements of the Education Code

respecting the termination of probationary or permanent certificated employees. This letter is

your notice of termination effective at the end of the current school year.

The District has initiated formal layoff proceedings to terminate the services of a number

of probationary and permanent employees, based on a reduction or discontinuance of particular

kinds of services. Although the District believes you are properly classified as a

_______________, you may believe otherwise. Therefore, you are being given the notice which

applies to probationary and tenured employees who are to be dismissed pursuant to the layoff

statutes of Education Code sections 87740 and 87743.

It is the District’s position that the layoff notice applies to probationary and tenured

employees and does not change your classification from ________________ to probationary or

permanent. However, if you believe that you are incorrectly classified as a temporary employee,

please inform the personnel office in writing as soon as possible.
