will express regret therefor, and undertake

:

to the Court never again to carry out or

be concerned in carrying out transactions

of a similar nature, or in any way to act as

;

a Solicitor or conveyancer contrary to the

' said Statutes.

" 2.

The defendant will submit to an

' Order for the payment of such penalty

' under 27 Vict., Cap. 8, as the Circuit Judge

' may think fit to impose.

" 3. The plaintiffs, the Incorporated Law

' Society of Ireland, having regard to the

' admissions of the defendant, and with the

' consent of the Attorney-General already

' obtained, will not press for the penalty

'

under 61 and 62 Vict., Cap. 17, and will

' accept (subject to the consent of

the

' Circuit Judge) the admission and under-

' taking referred to in paragraph 1 hereof in

' respect of

the offence under the said

' Statute.

"4. The defendant agrees to pay to the

plaintiffs the sum of £30 as and for the

" costs and expenses of the plaintiffs of and

" incidental to these proceedings."

At

the hearing in Court, Counsel for

Plaintiffs, having

stated

the

case,

the

defendant personally in Court admitted the

facts as contained in paragraph 1

of the

memorandum, and expressed regret for what

he had done, and gave the undertakings set

out.

Judge Sheehy expressed his approval of

the Society bringing the action, and of the

course

adopted,

and directed

that

the

defendant should pay

£5

penalty under the

Conveyancers Act and the agreed sum of £30

to the plaintiffs for costs and expenses.
