a. If the results are negative, the employee will be returned to work. No additional action
need be taken unless the circumstances which gave rise to the suspicion require action.
The supervisor may refer the employee to the Employee Assistance Program based on the
circumstances which gave rise to the suspicion.
b. If the results are positive for illegal drugs, the supervisor will immediately begin
termination proceedings. The employee will not be allowed to resign. See Policy H-1,
Disciplinary Action.
c. If the tests results are positive (above the acceptable level) perhaps due to prescription
drugs for which the employee has a current prescription or for over-the-counter medication,
the employee will be taken home and the supervisor may take disciplinary action up to and
including termination based on the circumstances which gave rise to the suspicion. The
employee must be evaluated and may be required to participate in the City’s Substance Abuse
Program.
5. Should the employee wish to have the original sample retested, he may do so at his expense.
The employee has 48 hours to request and pay for the additional test. A second test involving a
new sample will not be conducted. If the employee chooses to have the original sample retested,
he will be placed on suspension, but no further disciplinary action will be taken until the results
of the additional test are reviewed by the City MRO and the supervisor is notified of the results.
