courses in the same subject area.

The student or parent is required to reimburse the state for any state

funds paid to a college or university for a course in which the student

was enrolled but did not secure a passing grade.

FUNDING FOR

The Post-Secondary Enrollment Option (PSEO) program was

replaced by College Credit Plus, beginning in the 2015-2016 school

year.

Under rules developed jointly by the superintendent of public instruction

and the chancellor, school districts (including JVSDs) can enter into an

agreement with a college or university to use an alternate funding

formula, or an alternate method to transmit, the amount the college or

university would be paid for participation in post secondary open

enrollment programs, including the seniors to sophomores initiative.

The rules may include direct payments, alternate funding formulas, and

even negotiated amounts.

The board of education is a body politic and corporate and, as such, can

be sued and can sue, can enter into contracts and can be contracted

with, can acquire, hold, possess and dispose of real and personal

property, and take and hold in trust for the use and benefit of the school

district, any grant or devise of land, and any donation or bequest of

money or other personal property.

An Attorney General’s opinion suggests that a board is not empowered

to delegate to its superintendent the authority to enter into contracts on

behalf of the board. However, the board at a regular or special meeting

“may lawfully ratify and adopt any contract made in the name of the

governing board by its superintendent.”

PRESCHOOL

PROGRAMS

A board of education may contract with a preschool provider to provide

preschool programs. The provider may be:

• Any organization receiving funds under the Head Start Act.

• Any nonsectarian eligible non-public school as defined in Division (H)

of Section 3301.52 ORC.

• Any non-profit childcare provider licensed under Chapter 5104 ORC.

DISABILITIES,

TUITION FOR

Preschool children with disabilities are also eligible for inter-district

open enrollment.

However, if a preschool child with a disability who is a resident of

one district receives special education from another district (not

through open enrollment but under an agreement between the

districts), the district providing the education may require the child's

district of residence to pay the tuition of the district providing the

education as calculated in accordance with existing law (rather than

half of that amount).

PRESCRIPTION

DRUGS

Boards of education are required to adopt a policy on the authority of

employees to administer prescription drugs. Effective July 1, 2011, the

only persons authorized to administer a drug prescribed for a student will

be licensed health professionals and employees who have completed a

drug administration training program conducted by a licensed health

professional and considered appropriate by the board of education.
