If boards do not adopt rules, then the personal leave becomes
unrestricted.
The superintendent or administrative designee must administer the
personal leave program.
PHONICS
EDUCATION K-3
School districts must provide phonics instruction in grades K-3 based on
standards adopted by the state board of education.
The state board is also required to provide training for teachers on the
use of phonics in reading instruction in K-3.

PILOT PROJECT,
INNOVATIVE
A board of education may submit to the State Board of Education an
application proposing an innovative pilot project under which the school
district could be exempted from certain statutory requirements and
minimum operating standards.
Certain statutory requirements (e.g. public retirement system
requirements, licensure, and the education of children with disabilities)
cannot be exempted.
While there is no definition of “innovative,” it is clear that the initiative
must at least be “new” for the district making the request and must
include beginning and ending dates (even if the ending dates might be in
subsequent school years).
However, any exemption from any standard or requirement of the
evidence-based model or from a minimum operating standard adopted
by the state board of education requires a waiver issued by the state
superintendent of public instruction.

PLEDGE OF
ALLEGIANCE,
POLICY ON
Each board of education must adopt a policy specifying whether the oral
recitation of the pledge of allegiance is “part of the school program.”
However, no student can be required to participate in the recitation, and
the policy must prohibit intimidation by students or staff aimed at forcing
participation.
A board of education shall not prohibit a teacher from providing in a
teacher’s classroom “reasonable periods of time for the oral recitation of
the pledge of allegiance to the flag.”
In addition, no board of education is permitted to alter the words used in
the oral recitation of the pledge of allegiance to the flag from the words
found in 4 U.S.C. 4.

POST SECONDARY
OPEN ENROLLMENT
OPTION
The Post-Secondary Enrollment Option (PSEO) program was
replaced by College Credit Plus, beginning in the 2015-2016 school
year.
School districts must implement annually by March 1 an awareness
program for students in grades eight through 11 and their parents
informing them of the availability of the post secondary enrollment option
for students in grades nine through 12. If the student opts to receive high
school credit, funds will flow to the university on a prorated basis and be
subtracted from basic aid. A student may not enroll in any college course
through post secondary open enrollment options if the student has not
