THE INSTITUTE OF TAXATION IN

IRELAND

There has been formed in Dublin a study group

affiliated to the London Institute of Taxation. It

is hoped after a period of time to form the group

into a properly constituted Branch.

In the year it

is hoped that there will be

periodic meetings; discussions and

lectures at

which information, experience and tax problems

can be exchanged. The Institute were responsible

for holding a one day seminar in Trinity College,

Dublin on 6th April, 1968.

STIPULATION AS TO COSTS

Now that the standard form of building contract

is available from the Society (10/- per dozen,

plus postage) we consider it an opportune time

to bring to the attention of members the opinion

of the Council in relation to costs.

In the 1964 edition of the Members' Handbook

at page 2328 opinion D.R. 24 states :—

"The Council disapprove of a stipulation in a

contract for sale making the purchaser liable

for

the vendor's costs whether

the sale

is

effected by way of conveyance or

lease by

public auction or private treaty in as much as

it tends to suggest to the purchaser to retain

the vendor's solicitor".

The Council expressed another opinion in exten

sion of the foregoing in the October/November

1964 issue of the Society's Gazette (Vol. 58) No.

5, p. 45. They considered that a clause in the

building contract which read :—

"The employer shall be liable for all legal costs

and expenses incurred by the builder in connec

tion with this contract and matters incidental

thereto including the cost of grant applications

in addition to the contract price herein stated",

was analogous to that already referred to. Accord

ingly opinion D.R. 24 was extended to include
