Landlord Response: All necessary documents required by Landlord’s lenders have been

20.
Internal Stairways
Please confirm the ability to improve or further improve the Internal Fire Stairways so that CareFirst can use
them to travel between floors.
Landlord Response: CareFirst, as part of the Tenant Improvement work shall have the ability to
improve the Internal Fire Stairways.
21.
ADA Compliance of the Building, Common Areas, and the Premises
Please confirm that Landlord shall be solely responsible for the ADA compliance of
all
restrooms and Building
Common Areas (including
all
multi-tenant configured elevator lobbies) for the Term (Tenant shall be solely
responsible for ADA compliance only for its Premises).
Landlord Response: Agreed
22.
Tenant Improvement Construction
Please respond to the following requests concerning the construction of CareFirst’s Tenant Improvements:
a.
CareFirst, at its option, will be permitted to manage the construction of the Tenant Improvements.
CareFirst may elect that Landlord manage the construction of the Tenant Improvements, and Landlord’s fee
shall be capped at 3% of the hard costs for construction. If CareFirst elects to manage the Tenant
Improvements itself, Landlord shall not charge any sort of fee – management, supervisory or otherwise
(reasonable third-party review fees for critical Base Building items are acceptable);
Landlord Response: Merritt Construction Services will act as the General Contractor for the
construction of the Tenant Improvements.
b.
CareFirst will be permitted to select the architectural and engineering firms to complete its
drawings. CareFirst will also be permitted to select the General Contractor and any other vendors it deems
necessary to support the interiors construction, FF&E installations or network infrastructure.
Notwithstanding the foregoing, generally there should be no Landlord restrictions on CareFirst vendors of
any type. Please confirm;
Landlord Response: CareFirst will be permitted to select the architect for the Tenant
Improvement drawings, the cost of which shall be paid for by CareFirst. Merritt Construction
Services will act as General Contractor and will select the vendors for all required Tenant
Improvement Work. CareFirst will be permitted to select the vendors for FF&E installations as
well as network infrastructure.
