Abstrakt
Kapitola analyzuje postavenie a umiestnenie ľudských práv v medzinárodnopráv-
nom poriadku. Autorka vysvetľuje, ako sa medzinárodné právo zmenilo postupným
začleňovaním ľudskoprávnych noriem do jeho právneho systému a utváraním medzi-
národnoprávneho hierarchického poriadku. Zamýšľa sa nad ľudskými právami ako
súčasťou všeobecného medzinárodného práva pôsobiaceho erga omnes a polemizuje
o kogentnej povahe ľudských práv. V tomto kontexte analyzuje právne účinky s tým
spojené, vrátane prípadnej interakcie ľudskoprávnych noriem s článkom 103 Charty
OSN. Autorka prichádza k záveru, že základné ľudské práva sú súčasťou všeobecného
medzinárodného práva, avšak súčasné medzinárodné právo im všetkým nepripisuje
kogentný charakter.
Abstract
The present chapter analyses the status and the place of human rights within the
international legal order. The author elucidates how the international law has changed
since the emergence of human rights norms in its corpus and the evolving of the
international hierarchical legal order. She reflects on human rights as a part of general
international law applicable erga omnes and discusses their possible peremptory
nature. In this context she deals with the legal implications including the interaction
of human rights norms with the Article 103 of the UN Charter. She comes to the
conclusion that although basic human rights are a part of the general inernational law
the current international law does not attribute the jus cogens character to all of them.
