STATUS OF CHILDREN‐REFUGEES
IN THE EUROPEAN UNION LAW

Abstrakt
Tento příspěvek je věnován problematice dětských uprchlíků a jejich ochraně v prá-
vu Evropské unie. Tato sub-regionální úprava přináší pro postavení dětí nesporná po-
zitiva, jak v rovině hmotného práva, tak – a to zejména - práva procesního. Ať již to je
jejich podřazení pod tzv. zranitelné skupiny, anebo vyšší standard péče věnovaný nezle-
tilým bez doprovodu, kupříkladu skrze ustanovování opatrovníka. Příspěvek předsta-
vuje práva, která jsou v instrumentech Evropské unie dětem garantována, a analyzuje
je především z hlediska opravdového přínosu pro děti a jejich efektivity. Úvahy jsou
zasazeny do širšího kontextu úpravy této otázky v mezinárodním právu.
Abstract
This article deals with the problem of children-refugees and their protection in the
law of the European Union (EU). The system of EU law, a sub-regional system, brings
apparent benefits to the status of refugees, who are children. The benefits may be seen
mainly in the procedural norms, but not only there. The children are counted as a
vulnerable group, those, who are unaccompanied minors, are given higher standard
of care, inter alia are immediately appointed a representative. The aim of the article is
to introduce the rights guaranteed to children-refugees in the EU law and to analyse
effectiveness of those rights and their real benefit for children. Reflections are set into
the context of the relevant parts of international law.
